Right of Withdrawal

The consumer has the right to exercise the right of withdrawal within 14 days and withdraw from a distance contract without giving any reason.

In the case of the purchase of goods, the withdrawal period is calculated from the day on which the consumer, or a third party indicated by the consumer other than the carrier, has received the goods. The calculation of the period effectively begins on the following calendar day after receipt of the goods.

To exercise the right of withdrawal, you must clearly inform us of your decision to withdraw from the purchase within the 14-day period.

The consumer is responsible for retaining proof that the notification regarding the exercise of the right of withdrawal was sent within the specified period.

Returning the Product After Notification of Withdrawal

After submitting notification of the exercise of the right of withdrawal, the product must be sent or delivered back to Fiziopreces.lv without undue delay and no later than 14 days after submitting the notification.

Before sending the product back, we recommend contacting us to confirm the return details.

The direct cost of returning the product is borne by the buyer.

Please pack the product carefully and securely for return shipment to prevent damage during transportation. We recommend using a trackable delivery method and retaining proof of shipment.

Product Inspection and Use

During the withdrawal period, the consumer has the right to inspect and test the product only to the extent that would be possible when purchasing the product in a physical retail store, in order to determine its nature, characteristics and functioning.

The consumer is responsible for any diminished value of the product resulting from handling or use beyond what is necessary to determine the nature, characteristics and functioning of the product.

Upon receiving a returned product, Fiziopreces.lv will inspect its condition, completeness and any possible signs of use or damage.

When assessing any possible diminished value of the product, factors that may be taken into account include, for example:

  • visible signs of use or wear;
  • scratches, mechanical damage or other damage;
  • dirt, stains, odours or other signs of use;
  • use of the product for procedures, training or another intended purpose beyond what is necessary to inspect and test the product;
  • damaged or missing accessories or components;
  • missing chargers, cables, applicators, attachments, instructions or other items included with the product;
  • other circumstances as a result of which the actual value of the product has decreased after its return.

If an objective reduction in the value of the product is identified, Fiziopreces.lv is entitled, in accordance with applicable legislation, to take this into account when determining the amount to be refunded. The buyer will be informed of the identified reduction in value and the grounds for it.

Fiziopreces.lv is entitled to document the condition and completeness of the returned product and any identified damage or signs of use, including by taking photographs.

Original Packaging and Completeness

The product must be returned in its original packaging together with all accessories, documentation and other components included with the product.

The absence of the original packaging does not in itself remove the consumer’s right of withdrawal if it was not possible to properly inspect or test the product without opening the packaging. However, where damage to or the absence of the packaging or its components objectively reduces the value of the product, this may be taken into account when assessing the diminished value of the product.

If a product was purchased as a set or integrated system, all components included in the set must be returned when exercising the right of withdrawal in respect of the entire purchase.

The return, replacement or exchange of an individual component of a set for another size or model does not form part of the statutory right of withdrawal and is possible only by prior individual agreement with Fiziopreces.lv.

Product Exchanges

The statutory right of withdrawal does not provide an automatic right to request the exchange of a conforming product for another size, model, colour or another product.

If you wish to exchange a product, please contact us. If the requested exchange is possible, Fiziopreces.lv may offer an exchange of the product or an individual component of a set based on an individual agreement.

Hygiene and Health Protection Products

The right of withdrawal cannot be exercised in cases where the consumer has opened the protective packaging or seal of a product which, after the packaging has been opened, cannot be returned for health protection or hygiene reasons.

This restriction applies only to products for which, taking into account their nature, intended use and health or hygiene considerations, the relevant statutory exception objectively applies.

Other Cases Where the Right of Withdrawal Does Not Apply

In cases provided for by applicable legislation, the right of withdrawal cannot be exercised, including where:

  • the product has been made according to the consumer’s individual instructions or is clearly personalised;
  • the consumer has opened the protective packaging of a product which cannot be returned for health protection or hygiene reasons;
  • the product, due to its nature, has become inseparably mixed with other items after delivery;
  • another statutory exception to the right of withdrawal applies.

Purchases Made by Legal Entities

The statutory 14-day consumer right of withdrawal applies to a consumer – a natural person who purchases a product for a purpose unrelated to their economic or professional activity.

The statutory 14-day right of withdrawal does not apply to legal entities or to purchases made for business or professional purposes, unless Fiziopreces.lv and the buyer have separately agreed otherwise.

Refunds

If the right of withdrawal has been exercised in accordance with applicable legislation, Fiziopreces.lv will issue a refund after the returned product has been received and its condition, completeness, possible signs of use and any diminished value have been assessed, insofar as such procedure is permitted under applicable legislation.

Fiziopreces.lv is entitled to withhold the refund until the returned product has been received or until the consumer has provided sufficient proof that the product has been sent back, whichever occurs first.

Upon receiving the product, Fiziopreces.lv will inspect its completeness, technical and visual condition and assess whether the product has been used beyond what is necessary to determine its nature, characteristics and functioning. If an objective reduction in value, damage, missing components or other circumstances affecting the value of the product are identified, Fiziopreces.lv is entitled, to the extent permitted by applicable legislation, to take such diminished value into account when determining the amount to be refunded.

If the buyer has selected a delivery method that is more expensive than the least expensive standard delivery method offered by Fiziopreces.lv, the additional difference in delivery costs will not be refunded.

The refund will be issued using the same means of payment that the buyer used for the original transaction, unless another arrangement has been expressly agreed with the buyer.

The refund will be made without undue delay and in accordance with the procedure established by applicable legislation after the circumstances necessary for processing the refund have been determined.

The time required for the refunded amount to be credited by the bank or payment service provider after the refund has been issued may vary depending on the relevant service provider.

Purchases with Inbank or Other Financing

If the purchase was made using financing provided by Inbank or another credit provider, when notifying Fiziopreces.lv of your intention to withdraw from the entire purchase, please also contact the relevant financing provider to clarify the procedure for terminating the specific credit agreement and settling any related payments.

Termination of the product purchase agreement and any related credit agreement is carried out in accordance with applicable legislation and the terms and conditions of the relevant financing service.

Contacting the financing provider does not cancel or extend the statutory period within which the consumer must notify Fiziopreces.lv of the exercise of the right of withdrawal.

Defective or Non-Conforming Products

The right of withdrawal is separate from the consumer’s right to submit a claim regarding a product that does not conform to the terms of the contract.

If the product you have received is damaged, has a manufacturing defect, does not function as intended or does not correspond to your order, please contact us at info@fiziopreces.lv, providing your order number and a description of the issue. Where possible, please also include photographs or videos that help identify the problem.

Such cases are handled separately in accordance with the consumer’s rights regarding goods that do not conform to the terms of the contract as provided for by the Consumer Rights Protection Law.
